Many of our clients have horror stories about unethical creditors chasing payments. The following information will help you understand your rights.
When can a creditor contact me?
Unless you agree otherwise a creditor is limited to the following contact times and locations:
By phone – No more than 3 times per week or 10 times per month. During weekdays from 7:30am to 9pm. During weekends from 9am to 9pm.
Face to face – No more than once a month. Weekdays and weekends 9am to 9pm and they should only visit your home if there is no other way of contacting you including mail and email. Visiting your work can only be conducted when all other methods of contact have been exhausted and you have not responded. They cannot visit during National public holidays.
Creditors cannot – Have you sent to prison, take or sell any of your property that they don’t hold as security unless they have a court order. They cannot take everyday household items or threaten, physically intimidate or harass you.
